Hougang by-election case: Judge dismisses AGC's appeal against 'no costs' ruling

 
 

A HIGH Court judge has dismissed a bid by the Attorney-General's Chambers (AGC) to appeal against his decision to exempt a Hougang resident from paying costs, after she failed to get a court declaration on by-elections.

Justice Philip Pillai decided on Wednesday morning against letting the AGC argue its case in the Court of Appeal, said the office of lawyer M Ravi.

Justice Pillai ruled two weeks ago that Mr Ravi's client, Madam Vellama Marie Muthu, would not have to pay costs despite failing in her bid for the court to declare that the Prime Minister does not have unfettered discretion in deciding whether and when to call by-elections.

This was because her bid "concerned public law issues of general importance" and she did not have private interest in making the application, Justice Pillai said.
