Fine instead of jail on appeal

| A WOMAN won her appeal in the High Court on Monday against a three-month jail sentence for having assaulted a pub patron four years ago.
Rachelgina Jasmine Tay Siew Gek, 25, now a sales executive, was instead fined the maximum $1,000 by Justice Choo Han Teck. She admitted in July to kicking Mr Darren Herbert Fleury, then 24, on the head and throwing a beer mug at him at Zzqueeze Pub at Duxton Hill on March 5, 2004. The offence was committed with three others including her elder brother whose case is pending. Three other charges were taken into consideration. Her lawyer, Mr Terence C.S. Teo, argued earlier that Tay should not be jailed so as not to affect her rehabilitation. He said the fight was really between the men and Tay was 'misled'' into joining in after the victim had fallen. Tay, he added, has been working in a jewellery store since her release from a seven-month jail sentence for drug-taking. The single mother has been consistently ranked as the shop's top three sales persons. Deputy Public Prosecutor Kan Shuk Weng said the sentence was not manifestly excessive given what Tay had done. Setting aside the jail term, Justice Choo said Tay had conducted her life in a manner that showed she had learnt her lesson. ' It seems to me that it would be counter-productive to send her back to prison for three months for an offence committed two years before the offences for which she served her imprisonment last June,'' he said. | |
