Free use of 'LOVE'

JEWELLERS here can now freely use the word 'love' in capital letters to sell their products, without fear of legal action, following a High Court decision on Monday to revoke a trademark registered by a jewellery store. In 1999, The Carat Club, which has an outlet at Emerald Hill selling jewllery, registered the word 'LOVE' - four capital letters without any motifs or intricate design - as a trademark for its diamonds, precious stones and jewellery. Last November, rival jeweller Love & Co went to court demanding that The Carat Club revoke the trademark. Love & Co's move came after its sister company in Kuala Lumpur was served legal papers by The Carat Club to stop using the name. The case was heard by Justice Chan Seng Onn in May. He ruled in favour of Love & Co on Monday in a 64-page written judgement, declaring The Carat Club's 'LOVE' mark to be invalid and ordering that it be revoked. The judge found that 'love' is an ordinary word with well-understood meanings. Even before The Carat Club registered it as a trademark, many jewellers have used the word in their advertising slogans and also to name their jewellery collections. | |
