A MALAYSIAN man who filmed his female flatmate in the shower was given a day's jail and had his fine doubled to $8,000 on Friday.
Justice Lee Seiu Kin imposed the sentence on Gan Eng Hoe, 27, a quantity surveyor, after hearing the prosecution's appeal against his original sentence of a $4,000 fine.
The prosecution argued that the sentence was manifestly inadequate.
Justice Lee said he agreed with the policy that a severe sentence was called for when a recording device was used in these cases because there was a potential to multiply the victim's suffering.
Deputy Public Prosecutor Kan Shuk Weng said the district judge had placed too much weight on Gan's plea of guilt, had wrongly found that the level of planning in this case was low, and that Gan did not have a chance to view the photographs repeatedly as they were subsequently deleted.
Gan was given a $4,000 fine by a lower court after he admitted to insulting the modesty of a 27-year-old woman at a Housing Board flat in the east on April 29, 2008.
A second similar charge was considered.
The victim was taking her shower ini the kitchen bathroom when she noticed something black peeking through a drain. She quickly got dressed and saw that the door to the adjoining toilet cubicle was locked.
She told her husband.
After repeated questioning, Gan confessed and surrendered his digital camera and laptop to the victim. She made a report the next day.
